Man accused of robbing gas station with toy gun

BATON ROUGE, LA (WAFB) -

Police say a Baton Rouge man used a toy gun to rob a gas station of cash and nearly a dozen cartons of cigarettes.  

The robbery happened at roughly 9 p.m. on Tuesday, September 27. The clerk at the Exxon gas station on Florida Blvd. Reported the robbery to the Baton Rouge Police Department.  

"Upon arrival, patrol officers were quickly flagged down by an eye witness and informed that the suspects just fled the scene in a silver sedan traveling westbound on Florida Blvd," notes the officer in the probable cause report.  

The report states that the officer located a vehicle matching the description provided by the witness, but when the officer attempted to make a traffic stop, the driver allegedly sped up.  

"During the ensuing vehicle pursuit, the suspect vehicle left the road on several occasions and failed to stop at several stop signs at intersections," states the report. "The vehicle ultimately left the roadway and was involved in a single vehicle traffic crash at the intersection of Eugene Street and Laurel Avenue." 

Police say Treveon Smith, 19, and Brandon Brooks, 22, tried to run from police after the crash. They were quickly apprehended, however.  

Brooks, who was the passenger, was wearing an outfit that matched the description of the alleged robber, which was provided by witnesses.  

"Detectives reviewed surveillance video of the crime from the business's surveillance camera and observed [Brooks] entering the store wearing a red, white and blue bandanna around his face, marijuana themed multi-colored socks, and black converse all-star tennis shoes."  

After searching the vehicle, investigators located a "silver toy gun with a taped Glock magazine," ten cartons of menthol cigarettes and a gray hoodie jacket.  

A review of Brooks' criminal record includes a previous conviction for simple burglary in 2014. The report notes that he is currently under supervised probation.  

Both Brooks and Smith were arrested and charged with armed robbery and resisting an officer. Smith is facing an additional charge of aggravated flight from an officer.  

An additional person was in the vehicle and was arrested on charges unrelated to this case.
