BATON ROUGE, LA (WAFB) - On the morning of Friday, July 29, an East Baton Rouge Sheriff's deputy was dispatched to Santa Rosa Ave. in reference to a complaint from a victim, stating she'd been assaulted with a firearm.
The victim advised she had visited the Circle K on Gardere with a friend of hers, who is transgender, back on July 25. While at the gas station, she and her friend began talking with a man, Herbert James, 18, who exchanged phone numbers with her friend.
On July 28, the victim says that James and her friend went out on a date and had a sexual encounter. After the date, her friend allegedly texted James, saying she is a man.
The victim says James then came to her house to discuss the situation, when he became angry and removed a silver and brown revolver from his pants and threatened her with it.
The victim says she tried to calm James down, and once he left, she contacted the East Baton Rouge Sheriff's Office. Deputies were dispatched and began to patrol the area.
They located James inside a trailer park on Gardere Ln. and arrested him. James is a convicted felon and had an active warrant. He was then transported to the East Baton Rouge Parish Prison and was booked accordingly.
James is charged with aggravated assault with a firearm, felon in possession of a firearm, and illegal carrying of weapons.
