BATON ROUGE, LA (WAFB) - Authorities said a driver faces charges after a crash that killed his young passenger.
Elmer Menendez, 32, was booked Thursday into the East Baton Rouge Parish Prison on negligent homicide and other charges. The victim was identified as Fernando Menendez, 9.
Louisiana State Police reported the wreck happened on March 12 on Highland Road between Siegen Lane and Perkins Road around 11 a.m.
According to the probable cause report, deputies with the East Baton Rouge Parish Sheriff's Office said Menendez lost control of the vehicle he was driving. Deputies said they had not yet determined what caused Menendez to lose control.
Investigators stated the vehicle turned sideways and skidded across the center line and into the passenger side of another vehicle. They added the evidence showed Menendez was "operating his vehicle at a rate of speed, or in a manner that was unsafe for the conditions of the road at the time of the crash."
The report indicated it was determined neither of the people in the car had on a seatbelt and that the younger Menendez was thrown out of the vehicle after the collision. He was pronounced dead at the scene.
Menendez is charged with negligent homicide, careless operation, child not restrained and seatbelt violation. His bond was set at $6,100.
Troopers said they do not believe the weather was a factor in this crash.
