BATON ROUGE, LA (WAFB) - A 17-year-old was paralyzed after being shot in the back by his 8-year-old brother, and a Baton Rouge man has been arrested for allowing it to happen, according to an arrest warrant from the East Baton Rouge Parish Sheriff's Office.
An 8-year-old and his 17-year-old brother were spending the weekend with 23-year-old Robert Payne of Baton Rouge. During the visit, Payne allowed the brothers to play video games in his bedroom.
As they played video games, documents say Payne retrieved his .22 caliber ATI rifle. The 8-year-old turned his attention to Payne and the rifle.
Court documents go on to say Payne showed the child how the rifle functioned, including how to insert and eject the magazine. After the demonstration, Payne picked up the video game controller and focused on playing the video game.
While the 17-year-old and Payne were focused on the game, the child picked up the weapon and magazine, inserted the magazine into the gun, and fired the weapon. A bullet hit the 17-year-old in the back.
The 17-year-old's spine was shattered and is now paralyzed below the waist.
Payne has been charged with child desertion and negligent injuring. He has been released from the East Baton Rouge Parish Prison on a $1,000 bond.
