BATON ROUGE, LA (WAFB) - A Baton Rouge man was arrested Monday after he was charged with sexual battery, according to an affidavit from the East Baton Rouge Parish Sheriff's Office.
Documents say 47-year-old Kevin J. Southard is accused of fondling a woman while she was intoxicated. The woman went to visit her friend at the accused's house around 1 a.m. on Oct. 22. The report says during the course of the night, the victim and her friend consumed a large amount of alcohol.
The victim and her friend went to bed in the friend's bedroom. The affidavit states that sometime around 5:30 a.m. the victim woke up to Southard fondling her. She told deputies she slapped his hand away from her and moved away from him. Reports say he left the bedroom and she asked her friend to take her home.
On Oct. 27, Southard was arrested and charged with sexual battery. He is being held in the East Baton Rouge Parish Prison on a $6,500 bond.
Southard was previously convicted of cruelty to juveniles in 2012, according to court documents. The incident happened in 2008.
He was charged with two counts of aggravated incest and one count of cruelty to a juvenile. In the plea agreement, the aggravated incest charges were dropped and he was sentenced to 10 years hard labor. That sentence was suspended and he was given credit for time served. He was then sentenced to five years of supervised probation.
Southard's sentence was issued in 2013.
