BATON ROUGE, LA (WAFB) - If he recovers, Scott Rogers' accused killer could walk free and not face murder charges, 9News Investigators learned Monday from Lead Prosecutor Tony Clayton.
Mathew Hodgkins shot and killed Rogers, a TV personality, in a murder-attempted suicide. Hodgkins remains in a hospital fighting for his life.
"I question whether or not a person can establish the mental requisite or specific intent to commit murder and I just don't know if he had the specific intent because of the abuse he went through," Clayton said. "I don't see me prosecuting this individual for murder although it's ultimately up to a grand jury."
