Jindal sues Obama administration over Common Core

BATON ROUGE, LA (WAFB) -

Gov. Bobby Jindal filed a lawsuit in federal court Wednesday morning against President Barack Obama's administration over the Common Core education standards.

In the suit, Jindal argues the US Department of Education violated federal law and the Tenth Amendment by influencing states to adopt Common Core.

According to the governor, the Obama administration used federal grants to compel states to enter into binding agreements to adopt the standards. 

He added the Education Department made changes to the test review and approval process that will coerce states to adopt the tests the federal government prefers or risk billions of dollars in federal funding.

The lawsuit argues that is a violation of limitations set by Congress on the federal government's involvement in education policy.

"The federal government has hijacked and destroyed the Common Core initiative," Jindal said in a written release. "Common Core is the latest effort by big government disciples to strip away state rights and put Washington, DC in control of everything."

"These are decisions that should be made by local communities," said Jindal during a new conference in Lafayette Wednesday afternoon. "Of we allow the Federal Government to dictate our curriculum, if we allow them to make those decision, they determine what our children will be taught for several years."

The lawsuit states the US Department of Education used grants and other means to "herd" states together in order to nationalize education curriculum.

The Louisiana Department of Education issued a written statement about the suit.

"The Common Core state standards have been fundamental expectations in Louisiana for four years because our kids are just as smart and capable as any in America," spokesman Barry Landry wrote. "The courts have ruled and it is time to move on."

The Governor says this lawsuit is not about politics, despite some saying this is a ploy by the Governor to keep his name out on the national front in preparation for a presidential run.
