SELMA, N.C. -

A town councilor in Selma is backing off a proposal to ban baggy pants in public.

Councilor William Overby withdrew the idea from consideration at a council work session on Tuesday night.  He said he came to the decision after realizing no other municipality in the state had such an ordinance.

Overby said he believes sagging pants are indecent, but no longer believes it should be criminal.

Civil liberties groups have said such bans on styles of dress violate The Constitution's protections of free speech and due process.
