Magistrate rules state can close Sharonville abortion clinic

CINCINNATI, OH (FOX19) -

A Hamilton County magistrate on Monday upheld an Ohio Department of Health ruling to close a Sharonville abortion clinic.

Magistrate Michael Bachman said the Lebanon Road Surgery Center can stay open until July 10.

In October 2012, the department notified the clinic that the state health director proposed to issue an order refusing to renew the clinic's health care facility license. The department said the clinic violated a section of the Ohio Administrative Code that requires ambulatory surgical facilities to get a written transfer agreement with a hospital for the transfer of patients in the event of medical complications, emergency situations and possible other needs.

Attorneys for the clinic said they will appeal. Also, attorneys have said the clinic has complied with state law.
