BATON ROUGE, LA (WAFB) - Investigators have arrested a second LSU student in a case in which two other LSU students were recorded having sex.
Xavien Riascos, 18, is charged with video voyeurism. He was arrested Monday night and booked into the East Baton Rouge Parish Prison. His bond was set at $7,500. Asa Baker, also 18, was arrested on March 28 on the same charge. He was released the next day after posting a $7,500 bond.
The LSU Police Department said the incident happened at the Kirby Smith dormitory on March 23. LSUPD reported two students were videotaped having sex in a bathroom suite on the sixth floor. Authorities said Baker told investigators he and a friend went into the bathroom because they heard a female screaming.
"Once he was in there, he neglected to contact the police department or anything of that nature and did take the opportunity to videotape the incident," said Capt. Cory Lalonde with LSUPD.
Investigators said Baker then uploaded still images of the sex recording to Instagram. Detectives traced it back to Baker, who reportedly told them because the students were having sex in a bathroom, "they have no expectation of privacy." Lalonde said that is where Baker got it wrong.
"There is expectation of privacy in those incidents and our investigators felt that expectation of privacy was violated and a crime was committed according to the statute," Lalonde said.
The case has been sent to the district attorney's office for review.
