Three strikes and you're out: TEA to revoke Azleway's charter

TYLER, TX (KLTV) - On Wednesday, Azleway Charter School in Tyler was notified by the Texas Education Agency that their open-enrollment charter will be revoked on June 30, 2014. KLTV obtained a copy of the letter sent to the school by the TEA regarding the revocation of the charter and the events leading up to it.

According to TEA findings, Azleway was given an academic performance rating of "academically unacceptable" for the 2010-11 school year. For the 2011-12 and 2012-13 school years, the school also received a "substandard achievement" rating for financial accountability.

The TEA says the schools rights to appeal the ratings were "waived or exhausted" and the ratings are final and not appealable.

During the 83rd legislative session, the Texas Education Code was amended to include a statutory provision for the revocation of charter schools that failed to meet academic or financial accountability for the three preceding school years. The law states that failure to meet these standards will lead to mandatory revocation of a school's charter.

A conservator was appointed to oversee the financial management and governance of the school, direct the board in addressing the findings of the final report and overseeing all close-out activities of the charter school

The school was told they could submit a written request for an informal review and hearing of the agency's decision. If the school files an appeal by the deadline and the decision to revoke the charter is not overturned, the issue will be sent to the State Office of Administrative Hearings. The decision of the administrative law judge is final and can not be appealed.

Azleway Charter School, which opened in 1988, operates three campuses and educates children from first grade through high school. There are about 150 students enrolled in the system.

Five other Texas schools are also having their charters revoked:
  • American Youthworks (Austin)
  • Honors Academy (Farmers Branch)
  • Jamie’s House Charter School (Houston)
  • Koinonia Community Learning Academy (Houston)
  • Richard Milburn Academy (Suburban Houston Campus)
