LIVINGSTON, TX (KTRE) -

Stephen Yates, the owner of a local radio station, made a court appearance Tuesday morning.

The owner of Yates Media showed in up in a Polk County judicial district court room for a status hearing in regard to a motion to revoke his probation. Polk County District Attorney Lee Hon filed the motion to revoke Yates' probation following a domestic disturbance last month.

Joe Martin, a prosecuting attorney for Polk County, said that the court scheduled another status hearing for Yates for Jan. 21. At that time, they will likely set a date for his revocation of probation hearing.

Yates' troubled past with the law dates back to 1979. He is currently on a 10-year probation sentence which began in 2007 following his fourth DWI conviction out of Polk County.

Yates, 55, was arrested for violating his probation in April 2011, after he was caught driving a vehicle which did not have a breathalyzer in it. In May 2011, he was released on stricter conditions to his probation, which included surrendering his driver's license until his probation was over.

On Oct. 30, Yates was arrested after Lufkin police said he threw his girlfriend, Savanna Marberry, to the ground and pushed her and grabbed her throat. He was released later that day after posting a $1,500 bail.

According to the Lufkin police report, an officer saw a BMW M6 traveling southbound on South Timberland Drive at the intersection of Chestnut Street at 7:32 p.m. Monday. the officer stopped him and said Yates was driving the vehicle and learned he had a warrant out of Polk County for his arrest.

Yates is currently out on a $50,000 bail.
