Pleasant Plain councilman arrested on child porn charges


A Pleasant Plain councilman and volunteer firefighter is facing child pornography charges.

According to a complaint filed in U.S. District Court, a search warrant was executed on June 17 at the home of Nicholas Smith.

The National Center for Missing and Exploited Children received information from Yahoo! that a user uploaded 134 files, some of which depicted child pornography, on March 26, 2013. A subpoena was issued to Yahoo for information on the user, which led investigators to Smith.

While the warrant was being served, Smith confessed to the distribution, receipt and possession of child pornography, stating he saved and uploaded images on his computer. He admitted to uploading the photos to a Flickr account and then deleting the images. He said he would view images on various websites and exchange the images with persons on Yahoo! Messenger.

Smith is accused of distribution/receipt in interstate commerce of a visual depiction involving the use of a minor engaging in sexually explicit conduct and possession of a visual depiction involving the use of a minor engaging in sexually explicit conduct with an interstate nexus.

"To think someone like that would look at maybe a neighbors child or something in that fashion is pretty sick," said Pleasant Plain resident Peter Sheppell.

Smith, 26, also owns a landscaping business in Pleasant Plain.

He has been released from jail on bond and placed on house arrest.

Smith faces a maximum of five years in prison if he's convicted on the one count of receipt of child pornography.

Prosecutors will take the case to a federal grand jury in Cincinnati on July 3.
