David and Sabrina Kimbley were back in a Smith County family court Thursday for a custody hearing.

Their four youngest children have been in the state's custody since the couple's two-year-old son, Jake, was found dead in a septic tank on the family's property last August.

On Thursday, an attorney updated the court on the well-being of Sabrina Kimbley's oldest son, who has been in the custody of his father in Virginia.

This statutory permanency hearing confirmed that Mr. McPeters, the oldest son's father, is in compliance and said his son is adjusting well.

That child is receiving counseling and is "able to be a kid again," according to his attorney.

There is a placement review hearings scheduled for later this year.
