Holmes faces 166 charges in connection with the Aurora, CO movie theater shooting. (Source: CNN)(CNN) - A hearing is scheduled for April 1 to determine if prosecutors will seek the death penalty against the suspect in the Colorado movie theater shooting.
A judge last week entered a not guilty plea for James Holmes after his attorneys said they weren't ready to enter a plea.
The defense is still considering an insanity defense.
Holmes is accused of opening fire at a showing of a Batman film in Aurora last July, killing 12 people and injuring 58 others.
He's charged with 166 counts, including murder and attempted murder.
