A federal appeals court is ordering a lower-court judge to consider claims by an Arizona death-row inmate that he had ineffective legal representation.
Edward Harold Schad is scheduled to be executed next Wednesday for killing 74-year-old Lorimer "Leroy" Grove, of Bisbee, in August 1978. Grove's body was found in Yavapai County.
The U.S. 9th Circuit Court of Appeals on Tuesday ordered a federal judge in Phoenix to consider whether Schad had ineffective legal representation and whether there are grounds to consider his claims about sentencing proceedings.
The Attorney General's Office on Wednesday asked the 9th Circuit to have a larger panel of judges reconsider Tuesday's order issued by a three-judge panel.
A state clemency board hearing that was scheduled Wednesday for Schad was canceled.
