Number of Deaths from Fungal Meningitis Associated with Steroid Injections Produced by New England Compounding Center (NECC) Reach 40. Tennessee is Hardest-Hit State.

According to the U.S. Centers for Disease Control (CDC), the outbreak strain of meningitis has killed at least 40 people. Cases have been reported in 19 states. However, Tennessee, with 140 reports of illness and 14 deaths, is by far the hardest-hit state.

Tainted Steroid Meningitis Lawsuits
NECC recalled all of its products and voluntarily surrendered its license to operate on October 6, 2012. Prior to the recall, the potentially tainted steroids were shipped to 76 facilities in 23 states, the CDC said. According to The New York Times, NECC had a long history of questionable practices that had drawn warnings from the state and the Food & Drug Administration, and subsequent investigation found extensive contamination at its facility. According to a report from NBC News, NECC filed for Chapter 11 bankruptcy protection on Dec. 21, but has pledged to establish a fund for victims of the fungal meningitis outbreak.
In October, plaintiffs in fungal meningitis lawsuits petitioned the U.S. Judicial Panel on Multidistrict Litigation to establish a consolidated proceeding in a single federal court for all federally filed fungal meningitis claims [In Re: New England Compounding Pharmacy, Inc. Products Liability Litigation, MDL No. 2419]. According to the NBC News report, at least 400 fungal meningitis lawsuits have been filed against NECC by alleged victims of the outbreak.
