Updyke's bond revocation hearing rescheduled to Feb. 13 - WAFB 9 News Baton Rouge, Louisiana News, Weather, Sports

A Lee County judge has excused Harvey Updyke Jr. from attending  a bond revocation hearing after his attorney filed a motion Tuesday asking that his client remain in Louisiana during the proceedings.

But as it turns out, Updyke's bond was not discussed Wednesday as planned. Another hearing to discuss his bond has been scheduled to take place on February 13 at 9:00 a.m. local time.

Also, a hearing to discuss the status of the case is scheduled to take place March 15^th, with a tentative trial date set for April 8.

Updyke is expected to be present at these hearings.

The 64-year-old University of Alabama fan is accused of poisoning the Toomer's Corner oak trees with a powerful herbicide during Auburn's national championship run during the 2010 football season. The iconic trees are sacred to Auburn fans. It's at this location where victories are celebrated.

Lee County Judge Jacob Walker III originally ordered him to be present after the district attorney's office filed a motion arguing for revocation of his bond.  However, Judge Walker ordered Updyke appear for a hearing to discuss pending motions on February 13.

Updyke pleaded not guilty by reason of mental disease or defect to charges that include criminal mischief and desecrating a venerable object.

In late September, Updyke was in legal trouble in Lousiana where he allegedly refused a full refund at a home improvement store. Updyke was charged with "terrorizing" after he argued with a clerk at a home improvement store. 

Then in early October, he surrendered for psychiatric testing.  He was declared competent to stand trial after a mental examination hearing back November.  He was also granted release from jail on bond.

That ruling required that Updyke live with his daughter, and leave the home only during the daytime for medical, legal or religious reasons.
