The suspect was spotted inside the Target near 99th Avenue and Lower Buckeye Road in Phoenix on Oct. 17.
Surveillance video showed him walking into the store and standing very close to a woman shopping in the produce section.
"He literally leans over when she's not looking and places the camera underneath her dress," said Silent Witness Sgt. Darren Burch.
Burch said the guy snaps a cell phone photo underneath the unsuspecting shopper's skirt. Another shopper thought they saw something weird, so they reported him to a manager.
"He denies any involvement and wants to leave. They really don't have grounds to even detain him," Burch said.
Until officials watch the surveillance video, Burch said they have no proof the suspect did anything wrong, so workers walk him out of the store and he takes off.
"This type of crime is really voyeurism, if you think about it," Burch said.
Upskirting is a felony, and unfortunately it happens more often than you might think. Just a couple weeks ago, CBS 5 News showed you video of another suspected pervert. He's been spotted at a Michael's and 99 Cent Store lying on the ground looking up women's skirts.
"It's so hard to stop because it's hard to identify the crime. We get information after the fact," Burch said.
These suspects can claim they weren't doing anything wrong, and until police can review the tape, there isn't anything they can do about it.
Burch said if you're out shopping and wearing a skirt or dress, pay attention to anyone who gets a little too close, and if you see something like this happen, call police.
