Jury selection is underway in the trial of the Alabama fan accused of poisoning the twin oak trees at Toomer's Corner in Auburn.
Tuesday, lawyers involved in Harvey Updyke's trial said they wanted to know the favorite schools of the potential jurors. The trial is a few miles away from Auburn University's campus.
Among the questions being submitted by Updyke's attorneys is one asking whether potential jurors would "make a decision based upon the defendant being a University of Alabama sports fan."
About 85 potential jurors entered the courtroom. When asked if they had heard about the case, almost all of the potential jurors raised their hands. They were also asked if they could serve for two weeks, a possible indication of how long the court expects the trial to last.
Updyke allegedly poisoned the trees after Auburn beat Alabama during the Tigers' 2010 national title season. He faces two counts of first-degree criminal mischief, two counts desecration of a venerated object and two counts of unlawful damage to a crop facility.
