LOUISVILLE, KY (WAVE) - One of the men accused of killing a 15-year-old boy testified in another attempted murder trial Friday.
James Mallery took the stand in the attempted murder trial against John "Hot Boy" Jones. Jones is accused of shooting a woman during the early morning hours of New Year's Eve 2010.
In a taped jailhouse visit between Jones and Mallery, the Commonwealth claimed Jones asked Mallery to lie to the jury.
The defense said Mallery lied and used Jones to get out of jail.
During Friday's jury trial against Jones, Mallery shocked some in the courtroom. He was supposed to testify against Jones, but instead of helping prosecutors, the defense called Mallery to the stand.
In addition, Mallery allegedly sent letters to prosecutors claiming he had "bombshell evidence" in numerous cases.
Defense: Do you recognize that document?
James Mallery: Nah
Defense: In that letter, you don't offer the Commonwealth 'bombshell evidence' on numerous cases?
Mallery: Nah. And I never spoke on this case either
Mallery was granted shock probation, a form of early release, and left prison in February. The Commonwealth Attorney's Office agreed to that release in exchange for testimony in Jones' trial. That's one reason why Gregory Holt's family is upset.
Mallery is accused with 2 others of killing 15-year-old Gregory Holt April 11.
The family demanded a special prosecutor instead of the Commonwealth Attorney's Office be placed on the case because of Mallery's early release.
