Hearing for Bama fan accused of sexual battery on LSU fan postponed

NEW ORLEANS, LA (WAFB) -

The Alabama man accused of performing a sexual act on a passed out LSU fan was scheduled to appear in court Tuesday morning, but the hearing was postponed.

Brian Downing, 32, of Smiths Station, AL is charged with one count of sexual battery and one count of obscenity.

Downing is believed to be the man seen in a controversial video rubbing his genitals on the neck of a Tigers supporter inside the Krystal restaurant on Bourbon Street following the BCS Championship game in January.

The hearing was originally set for 10 a.m. A new date for the hearing was not set.

Downing turned himself in to the New Orleans Police Department after being identified as the suspect in the now-infamous video that went viral on the internet.

He was released on a $10,000 bond.

Sexual battery is a felony.
