BOSSIER PARISH, LA (KSLA) -
The mother of a Bossier Parish child allegedly killed by her father and stepmother in January of 2011 has taken legal action against her daughter's accused murderers.
Wesley Lowe faces a charge of negligent homicide in his daughter's death. The stepmother, Catherine Murray Lowe, has already been indicted on 2nd degree murder charges.
But Wesley and Catherine Lowe are not the only ones Jamie Mercer is suing in the case of Anna Celeste Lowe's death.
In the suit, Jamie Mercer names the Bossier Parish Sheriff's Office, the Ouachita Parish Sheriff's Office, the Department of Child Services and the Louisiana Attorney General's office as liable.
Mercer claims the little girl's death could have been prevented if earlier signs of abuse would have been investigated. KSLA News 12 spoke to Mercer's attorney, who says though she's seeking monetary damages, that's not the true purpose of the suit.
The Bossier Parish Sheriff's Office has rejected a request for comment on the suit - and a request for a copy of the December 9, 2010 police report, "Because of the upcoming court proceedings in the case and the pending lawsuit," according to Lt. Bill Davis. "Our ultimate objective for this matter is that justice prevail for young Anna Celeste, and we don't want to do anything that would jeopardize that during the adjudication process."
The Department of Child and Family Services has also declined to comment. According Communications Director Trey Williams, "State law prohibits us from speaking publicly regarding child abuse investigations and it is the policy of DCFS not to comment on pending litigation, but will wait until the appropriate time in court to relay the facts around this tragic case."
