BATON ROUGE, LA (WAFB) -

A bicyclist hit by a man charged with drunk driving on January 21 is now out of a coma and the hospital says he is in fair condition. Danny Morris was cycling with Nathan Crowson in the 6100 block of Perkins Road when police say Joseph Branch hit them from behind.

According to police, Branch, 28, had a blood alcohol level of .307 percent. The legal limit in Louisiana is .08 percent. Branch was nearly four times the legal limit. The accident happened just before 9 p.m.

Nathan Crowson was killed by the collision and Danny Morris was taken to the hospital with injuries to his lower body and was listed in critical condition.

On Friday, friends of Danny Morris say he was taken off the breathing machine and is breathing on his own. He has had at least three surgeries since the accident nearly a week ago. His spine was fractured, his pelvis separated and his left ankle was broken.

Branch was charged with second offense DWI and vehicular homicide.
