Boy injured after falling into uncovered storm drain

NOLENSVILLE, TN (WSMV) -

A 13-year-old boy is recovering after falling into an uncovered storm drain Thursday in Nolensville. The hole is about three feet long and two feet wide. 

DaVaughn Williams was knocked unconscious after hitting his head during the fall. His mother says several teeth were knocked loose and he suffered a gash on his leg. The boy was able to climb out of the drain and was staggering on the road when a neighbor found him and brought him to the hospital. The storm drains are on Carothers Road, the street where children used to walk home from the bus stop.

Channel 4 News has learned the about 40 storm grates in the Carothers Crossing subdivision had been stolen in October. The thieves were arrested and sentenced to probation, but the drain grates were never replaced. Some of the openings had plywood over them.

There's a lot of finger-pointing about who is supposed to replace the grates. Green Bank owns the subdivision after foreclosing on the developer. An attorney for the bank, Sam McAllester, says Metro's water and sewer department is supposed to fix the drains, but Metro says they are not responsible since the developer never turned the subdivision over to the city.

Four days after Williams fell into the storm drain, Channel 4 found the drain still uncovered. We called Metro Water and Sewer, who sent a contractor to place orange cones and portable barricades over the open holes Monday night.

Metro's planning commission says the developer had posted $1 million for the project. In October 2009, the planning commission asked the Metro Legal Department to collect the bond so that the road project could be finished, but a representative for the planning commission says the money has apparently never been collected.

    A man accused of an attempted armed robbery Thursday night was shot in the process and died early Friday morning, according to investigators. The Baton Rouge Police Department reported Kylin Spencer, 19, died at the hospital from gunshot wounds.
