An elementary school librarian is accused of choking a student who refused to sit down when told to do so.

According to the Baker Police Department, Maxine Gray, 67, was arrested on a cruelty charge Wednesday.

Police said the incident happened at Baker Heights Elementary on Sept. 1 and involved a 9-year-old boy.

Authorities were first contacted about it by the child's mother on Sept. 29. At that time, it was being looked into by the Baker School Board, but the mom told officers she wanted the matter investigated further and she wanted to file criminal charges.

Investigators said the boy told them he was in a class and Gray kept telling him to sit down but he didn't. He reportedly said he finally sat down, but then stood again.

Officers said the boy reported that's when Gray grabbed him by the shirt with one hand, around the throat with the other and started choking him. He said he eventually got away.

Gray was apparently watching the class while the regular teacher was away because the report stated the boy told his teacher about it when she returned moments later.

The student said when he went to take his seat Gray shoved him into the hallway and pushed him several more times.

The teacher told police she saw part of what happened. She claimed the boy was frantic when she walked into the classroom and said Gray had just choked him. She said she told him to go sit down, but he didn't make it to his chair.

The teacher explained she saw Gray grab the 9-year-old by the back of the neck and yell at him. She said he tried to get away, but the librarian had a hold on his shirt and back pack. Gray allegedly pushed the boy backwards, nearly causing him to fall. The witness added the librarian was still holding onto his shirt and pushed him out into the hallway.

The teacher said the two were yelling at each other and, as she tried to get the boy to calm down, saw Gray push him in the chest. The teacher said she then got between the boy and Gray and sent him to another teacher.

Investigators said after hearing from the teacher they talked to Gray to get her side of the story. They said she denied all allegations. She was then arrested and booked into the East Baton Rouge Parish Prison on cruelty to a juvenile.

Bond information was not provided.

A teacher at another Baker elementary school was arrested last week for allegedly attacking a student.
